Pool Safety Standards in New South Wales, Queensland & Victoria

Australia has some of the world’s strictest pool safety standards — and for good reason. These laws protect families, prevent drowning incidents, and ensure every pool has a compliant, well-maintained safety barrier.

Below is a clear, state-by-state guide to pool fencing, gate, signage, inspection and registration requirements in NSW, QLD and VIC.

1. New South Wales (NSW) #

NSW regulates pool safety under the Swimming Pools Act 1992 and Swimming Pools Regulation 2018. Compliance focuses on fencing, self-closing gates, CPR signage and mandatory pool registration.

Key Requirements #

• Gaps between vertical bars: **<100 mm**
• Ground clearance: **<100 mm**

• Latch must be **1.5 m above ground**
• CPR signage must be visible from the pool area
• Every pool must be registered on the NSW Swimming Pool Register

Inspections #

• Mandatory before **selling or leasing** a property
• Non-compliant pools must be rectified

Penalties #

• Fines up to **$5,500** for non-compliance

Penalties #

3. Victoria (VIC) #

Victoria enforces pool safety via the Building Act 1993 and Building Regulations 2018. Pools must be registered, inspected regularly, and fenced at all times.
